Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and Atilla Kasapbaşı, doing business as YouQue ("we," "us," or "our"). By accessing or using the YouQue website at youque.app or the YouQue mobile app (together, the "Services"), you agree to these Terms.

If you do not agree, do not use the Services.

We may update these Terms from time to time. We will give you at least 30 days' notice of material changes, except for changes addressing new functionality, security updates, bug fixes, or court orders, which may take effect immediately.

The Services are intended for users 18 years of age or older. Minors are not permitted to register.

1. Our Services

YouQue helps you decide what to watch by providing one personalized YouTube video recommendation per session, based on your selected mood, interests, and inputs. Recommendations are generated using AI processing. YouQue also includes social features that let you share recommendations with friends through direct messages and group chats, react to shared videos, and discover trending videos shared by the broader YouQue community through the Explore feature.

The Services are not tailored to comply with industry-specific regulations (HIPAA, GLBA, etc.). If your use would require such compliance, you may not use the Services.

2. Intellectual property

We own or license all content, software, source code, designs, trademarks, and other intellectual property in the Services. You may access and use the Services for your personal, non-commercial use only.

You may not copy, modify, distribute, sell, lease, or reverse-engineer any part of the Services without our written permission.

3. Your representations

By using the Services, you confirm that:

• All information you submit is accurate and current
• You will keep your account information up to date
• You have the legal capacity to agree to these Terms
• You are not a minor in your jurisdiction
• You will not access the Services through bots or automated means
• You will not use the Services for any illegal purpose
• Your use of the Services will comply with applicable law

4. Account registration

You may need to register to use the Services. Keep your password confidential — you are responsible for all activity under your account. We may reclaim or change usernames at our discretion if they're inappropriate or objectionable.

5. Purchases and payment

YouQue subscriptions are sold through:

• Apple App Store in-app purchases
• Google Play in-app purchases

All payments are processed by Apple or Google. We never see or store your payment card information. Prices are listed in US dollars; Apple and Google convert to your local currency at checkout. We may change prices at any time, with notice as required by law.

6. Subscriptions

Billing and renewal

YouQue subscriptions automatically renew unless cancelled. By subscribing, you authorize Apple or Google (whichever store you used) to charge your payment method on a recurring basis. Billing cycles are monthly or annual depending on the plan you choose.

Free trial

We offer a 7-day free trial to new subscribers. At the end of the trial, your account will be charged for the subscription plan you selected unless you cancel before the trial ends.

Cancellation

You can cancel your subscription at any time through your Apple App Store or Google Play account settings. Your cancellation takes effect at the end of the current paid period. We do not provide refunds for partial billing periods (see Refunds).

Price changes

We may change subscription prices from time to time. We will communicate any price changes to you in advance as required by applicable law.

7. Prohibited activities

You may not use the Services for any purpose other than what we provide. Specifically, you agree not to:

• Systematically extract data from the Services
• Defraud or mislead us or other users
• Circumvent security features
• Disparage, tarnish, or harm us or the Services
• Use information from the Services to harass other users
• Use the Services in violation of any law or regulation
• Engage in unauthorized framing or linking
• Upload viruses, malware, or harmful code
• Use bots, scrapers, or automated tools
• Remove copyright or proprietary notices
• Impersonate another user
• Interfere with the Services' normal operation
• Harass our staff
• Reverse-engineer the Services
• Use the Services to advertise or sell goods and services
• Sell or transfer your profile
• Harass, threaten, or intimidate other users through messages, group chats, or any social features
• Share content that is illegal, obscene, defamatory, or infringes on third-party rights
• Attempt to extract, scrape, or systematically download YouTube video data through the Services
• Use the Services to distribute spam, malware, or unsolicited promotional content
• Impersonate another user, YouQue, or any third party
• Attempt to bypass the recommendation system, age verification, or other security measures

8. User content

The Services let you submit content — messages, mood inputs, reactions, shared videos, and similar contributions ("Contributions"). When you submit Contributions, you represent and warrant that:

• You own or have all necessary rights to the Contributions
• Your Contributions do not infringe anyone's intellectual property or privacy rights
• Your Contributions are not false, misleading, illegal, obscene, harassing, or otherwise objectionable
• Your Contributions don't violate any law

We may remove or edit Contributions at our discretion without notice.

9. Content license

By submitting Contributions, you grant us a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, distribute, and display them in connection with operating and promoting the Services. You retain ownership of your Contributions — we just need the rights to operate.

10. Mobile app license

We grant you a non-exclusive, non-transferable, limited license to install and use the YouQue mobile app on devices you own. You may not reverse-engineer, modify, sublicense, or commercially exploit the app.

If you got the app from Apple or Google, you also agree to their respective terms of service. Apple and Google are third-party beneficiaries of this license and may enforce it directly against you.

11. Social logins

You may sign in with Google or Apple. By doing so, you authorize us to access basic profile info (name, email, unique ID) from that account. Your relationship with the third-party provider is governed by their terms, not ours. You can disconnect at any time in account settings.

12. Third-party links

The Services link out to YouTube and other third-party websites. We don't control these sites and aren't responsible for their content, accuracy, or privacy practices. When you leave YouQue to visit a third-party site, these Terms no longer apply — review the other site's terms.

13. Services management

We reserve the right (but have no obligation) to: monitor the Services for violations, take legal action against violators, refuse or restrict access to Contributions, remove excessive or burdensome content, and otherwise manage the Services to protect our rights and ensure proper functioning.

14. Privacy

Our Privacy Policy explains how we collect and use your data. By using the Services, you agree to the Privacy Policy. The Services are hosted in the United States and Ireland. If you access the Services from elsewhere, your data may be transferred to and processed in those countries.

15. Copyright complaints

We respect intellectual property. If you believe content available through the Services infringes your copyright, send a notice to [email protected] with:

• Your contact information
• A description of the copyrighted work
• The location of the allegedly infringing material on the Services
• A statement under penalty of perjury that you are authorized to act
• Your physical or electronic signature

Note: most video content is hosted by YouTube, not YouQue. For YouTube videos, file a copyright complaint with YouTube directly at youtube.com/copyright_complaint_form.

16. Term and termination

These Terms remain in effect while you use the Services. We may deny access, suspend, or terminate your account at any time, in our sole discretion, for any reason — including violation of these Terms or applicable law — without notice or liability.

If we terminate your account, you may not register a new one under your name or any other name. We also reserve the right to pursue legal action.

17. Modifications and interruptions

We may change, suspend, or discontinue any part of the Services at any time without notice. We are not liable for any loss or damage caused by unavailability of the Services.

18. Governing law

These Terms are governed by the laws of the Republic of Turkey. You and YouQue agree that the courts of Turkey have exclusive jurisdiction over any dispute under these Terms, subject to the arbitration provisions below.

19. Dispute resolution

Informal negotiations

Before initiating arbitration or litigation, you and YouQue agree to first try to resolve any dispute informally for at least 30 days. Send notice to [email protected].

Binding arbitration

If informal negotiations fail, any dispute arising out of or in connection with these Terms shall be resolved by binding arbitration. The arbitration shall be conducted by one arbitrator, seated in Istanbul, Turkey, in English and Turkish, under the Rules of Arbitration of the Istanbul Arbitration Centre (ISTAC) or, if ISTAC is unavailable, under another recognized institutional arbitration framework agreed by the parties.

Restrictions

Arbitration shall be limited to disputes between you and YouQue individually. To the extent permitted by law, no class arbitration is allowed; no dispute may be joined with another proceeding; no dispute may be brought on a representative basis.

Exceptions

The informal-negotiations and arbitration provisions do not apply to: (a) disputes about enforcing or protecting intellectual property rights, (b) claims related to theft, piracy, privacy invasion, or unauthorized use, or (c) claims for injunctive relief. These may be brought directly in court.

20. Disclaimer

THE SERVICES ARE PROVIDED "AS-IS" AND "AS-AVAILABLE." YOU USE THE SERVICES AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranty that the Services will be uninterrupted, error-free, secure, or accurate. We are not responsible for content provided by third parties (including YouTube videos), for personal injury or property damage from your use of the Services, for unauthorized access to your data, for service interruptions, or for any loss resulting from your use of any content available through the Services.

21. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR REPRESENTATIVES ARE NOT LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL — ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US DURING THE SIX (6) MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions don't allow these limitations. If you live in one of them, the above may not fully apply to you and you may have additional rights.

22. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your Contributions, your use of the Services, your breach of these Terms, your violation of third-party rights, or any harmful act toward another user.

23. YouTube content and third-party services

YouQue uses the YouTube Data API to provide video recommendations. All video content displayed within YouQue is hosted by YouTube and is subject to YouTube's Terms of Service and Google's Privacy Policy. YouQue does not own, host, or control the YouTube videos shown through the Services. We are not responsible for the availability, accuracy, or content of any YouTube video, and YouTube may modify or remove videos at any time without notice.

24. Refunds

All purchases of YouQue subscriptions are processed by the Apple App Store or Google Play Store. Refund requests must be submitted to the relevant platform through their respective refund processes:

• Apple: reportaproblem.apple.com
• Google Play: through the Play Store app on your device

YouQue does not process refunds directly and cannot override Apple's or Google's refund decisions.

25. Miscellaneous

These Terms (together with our Privacy Policy and any other operating rules we post) are the entire agreement between you and us. Our failure to enforce any provision does not waive that provision. If any provision is found unenforceable, the remaining provisions stay in effect. We may assign our rights and obligations at any time. No partnership, joint venture, or employment relationship is created. You waive any defenses based on the electronic form of these Terms.
